Appoint Executor

It is important to appoint trustworthy executors who will ensure that your will is executed according to your wishes.

You may appoint Awqaf SA as the

• sole executor (Option 1) or

• jointly with other executors (option 2),

• or in the event following the death of of all nominated executors (option 3) to your Will.

The relevant clauses that must be inserted in your will for either option are as follows:

Option 1: Appointment of Executor – Sole Executor

I hereby nominate and appoint the National Awqaf Foundation of South Africa (Awqaf SA) Registered Trust No. T1269/03 or its nominee/s or successor/s to be the executor(s) and administrator(s) of my estate.

I hereby give and grant to my executor(s) and administrator(s) such power and authority as is required or allowed in law and especially that of assumption.

 Option 2: Appointment of Executor - Joint Executor

I hereby nominate and appoint the following person(s) to be the executor(s) and administrator(s) of my estate:

(1) National Awqaf Foundation of South Africa (Awqaf SA) Registered Trust No. T1269/03 or its nominee/s or successor/s

(2) ………………………………………………………………………………………………………………………………………

(3)……………………………………………………………………………………………………………………………………….

In the event of any one or more of my said Executor(s) or Administrator(s) predeceasing me, or dying during his/her term of office or declining to act or vacate office for any reason whatsoever, then the remaining or surviving Executor(s) or Administrator(s) shall be authorized to act alone. I hereby give and grant to my Executor(s) and Administrator(s) such power and authority as is required or allowed in law and especially that of assumption.

Option 3:  Clause for the Appointment of Awqaf SA as Executor & Administrator following the death of the nominated Executor (s) & Administrator (s)

In the event of any of my said Executor(s) or Administrator(s) predeceasing me, or dying during his/her term of office or declining to act or vacate office for any reason whatsoever, then the remaining or surviving Executor(s) or Administrator(s) shall be authorised to act alone. In the event of none of my said Executors) and Administrators) being able to act then I hereby nominate and appoint the following person(s) to be the Executors and Administrators) of my estate:

National Awqaf Foundation of South Africa

Registered Trust No. T1269/03 or its nominee/s or successor/s

I hereby give and grant to my Executor(s)  and  Administrator(s) such power and authority as is required or allowed in law and especially that of the Power of Assumption.

Should you wish you to leave a legacy or make a waqf through your will go to Waqf Al Wasiyyah for sample clauses.
